Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda., with headquarters at Parque Industrial de Sezim, Rua de Vilar, Nº 844 4835-256 Guimarães – Portugal, NIF nº 505391341 is the legitimate owner of the official JORLOP brand website, whose domain can be found at https://jorlop.pt.

3. OBJECT AND SCOPE

These General Terms and Conditions of Sale exclusively regulate the purchase and sale made in the Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda online store, between the “Customer” as buyer and “Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda” as seller and apply to all visitors to the www.jorlop.pt website, as well as to any commercial transaction made through this online store.
3.2. Browsing the website and purchasing any product at www.jorlop.pt implies acceptance of these general conditions of use and contracting.
3.3. A “Customer” or “User” or “Buyer” is any person who acts on/buys products from the JORLOP online store.
3.4. Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda” reserves the right to change these conditions of use and contract without prior notice, as well as to modify at any time the information and commercial offer presented on products, prices, promotions, commercial conditions and services, and any changes will always be published on the website www.jorlop.pt.
3.5. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” reserves the right not to process any order received from users who do not agree with the general conditions of sale of the ‘Seller’ (JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA).
3.6. The “Customer” must provide “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA”, as the purchaser, with an e-mail or postal address, or data relating to another form of contact, that is correct and complete and accepts that JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA may contact him/her using this data, should it deem it appropriate.

4.5. All the contractual information is written in Portuguese, as is the information on the articles, e-mail communications and the formalization of the sale, with the exception of expressions that are very specific to the universe of the products.
5. TRADE POLICY
5.1. In the event that the information presented does not correspond to the characteristics of the product, the Customer has the right to terminate the purchase contract under the applicable legal terms.
5.2. The photographs shown on the website are merely illustrative. For further information on the products sold, we recommend that you consult the information provided and/or consult the brand/supplier’s website.
5.3. Prices and product features are subject to change without prior notice.
5.4. Validation of the purchase order assumes that the “Buyer” is aware of and accepts the General Terms and Conditions of Sale of the www.jorlop.pt website.
5.5. All the data recorded by “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” constitutes proof of all the transactions carried out between “Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda” and the “Client”, and it is the responsibility of “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” to archive the electronic document formalizing the contract and to keep it accessible.
6. OBLIGATIONS OF CUSTOMERS AND USERS
6.1. Any visitor to the www.jorlop.pt website undertakes to comply with and respect these general conditions, in particular by observing the following obligations:
6.1.1. It is forbidden to introduce, store or disseminate through the JORLOP website defamatory, obscene, insulting, xenophobic and/or any other type of content that violates the general principles of law and public order;
6.1.2. Save, and do not disclose, your password for entering the website in order to prevent third parties from accessing your account and personal data;
6.1.3. Do not use false identities;
6.1.4. Provide your personal data and correct addresses so that “Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda” can process orders properly;
6.2. The “Customer” is solely responsible for the veracity of the personal data communicated to “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” and undertakes to enter and immediately inform any changes through their Registration Account at www.jorlop.pt.
6.3. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” disclaims any liability for any delay or impossibility of processing the order due to error or insufficiency of the data communicated by the ‘Customer’.
7. ONLINE ORDERING
7.1. In order to place an order at www.jorlop.pt, the “User” must have a valid, frequently-used e-mail account and register as a customer by filling in the form available online. Once registered, simply insert all the products you wish to purchase into the virtual shopping cart, following all the steps of the purchase so that it is completed successfully. The registration process can also be carried out during the purchase process, and will be requested if applicable.
7.2. Place an order at www.jorlop.pt:
1. For non-personalized products, go to the “Online Shop” page and choose the products from the category menu, entering the page of the product you want and clicking on the “Add” button, which is on the right-hand side of the product image, just below the quantity selector. Repeat these steps for all the products you want.
2. Review your order and all the products you have selected by clicking on the shopping cart at the top right of the store. Here you can remove products from the cart as well as increase or decrease the units ordered of each product.
3. Click to finalize your order and you will be directed to the checkout process. If you are already a user, enter your login details here. If you haven’t registered yet, enter your email address and click on “Create an account”.
4. After filling in all the details and finalizing the order, make the payment using the details that will appear on the screen. You will also receive a summary of your order in your email.
5. For personalized products, go to the “Personalized” page and choose the products from the category menu, then go to the page for the product you want and fill in the available quotation and order form. Repeat these steps for all the products you want.

7.3. As soon as you complete your purchase, you will receive an automatic e-mail confirming the transaction with a summary of your order. We suggest you download this copy for future reference. This summary will also be available on your account page. If the data is not correct, you should immediately ask for it to be changed, or even for the purchase to be canceled.
7.4. In the event of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” reserves the right not to accept your order, or to cancel it in whole or in part, even after it has been automatically confirmed.
8. PRODUCT AVAILABILITY AND ORDER CONFIRMATION/CANCELLATION
8.1. “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” only processes an order placed by a customer after confirmation of the respective payment, so ‘JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA’ cannot guarantee the availability of the items until this processing begins.
8.2. During the order process you will be informed of the estimated date of dispatch or availability of the products. The estimated shipping time may vary depending on the destination of your order.
8.3. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” only ships orders on working days. Therefore, weekends and public holidays are not taken into account when estimating delivery times. Any delay in the dispatch of items, compared to the estimated dates shown, does not give rise to the right to compensation.
8.4. Fulfillment of all orders placed on the website is subject to product availability. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA tries to ensure that all items offered for sale on the website are in stock. However, “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer in stock. In the event of product unavailability and/or out of stock, “Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda” will immediately inform the “Customer” of the partial or total cancellation of their order, and the buyer is entitled to a refund of the applicable amount or credit of that amount for purchases on the website, whichever is preferred.
9. ORDER CONFIRMATION OR CANCELLATION
9.1. Orders submitted to www.jorlop.pt for delivery by post or courier will only be considered confirmed and processed once they have been properly collected.
9.2. If the products ordered at www.jorlop.pt are no longer available at the time of your last access to the site, despite having obtained confirmation of the order, or when “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” receives your order, “Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda” will immediately inform the “User” of their unavailability.
9.3. If an order has been placed, and payment made, for products that have since become unavailable, “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” will refund or credit to your account the money paid for the unavailable items.
9.4. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” reserves the right to refuse any order for any reason and disclaims liability for any damages or costs, as well as the right to cancel any purchase even if it has already been accepted or confirmed by ‘JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA’, namely in the following situations:
The information on the invoice is not correct or verifiable;
The order is flagged by the website’s Security Systems as an incorrect, irregular order, or an order susceptible to fraud;
When payment for the order is not received within 2 working days of submitting your order;
When it is not possible to deliver the order to the address provided by the “User”;
If it considers that the “Buyer” did not have the capacity to carry out that act.
If it is found that there has been an error in the presentation of the price of the product(s);
10. PAYMENT TERMS AND SECURITY GUARANTEES
10.1. The available payment methods will be shown at www.jorlop.pt. We do not accept any other payment method than those mentioned.
10.2. In the case of orders to be sent by post, products can be paid for using a credit card or Multibanco reference, and the JORLOP website provides the necessary instructions for this method of payment. In the case of orders for collection at the premises or home delivery, payment can be made using a credit or debit card, as well as cash.
10.3. For payments using a credit card, all details (such as the card number, expiry date or security code) will be sent by encrypted protocol to the company providing the remote electronic payment services, without third parties being able to access the information transmitted. This information will not be used by “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA”, except to carry out the necessary operations for purchase or reversal (refund), in the case of return in accordance with the exercise of the right of return, or for reporting cases of fraud to the police authorities.
10.4. If the “Consumer” chooses to pay by ATM reference, we will only start processing the order once we have received the payment. Therefore, with this payment method, we advise you to go to the ATM/Netbanking as soon as possible so that you receive your order as soon as possible. Once 2 calendar days have passed since the order was placed, and if we have not received any payment, the order will be canceled.
10.5. The total amount indicated on the order form comprises the purchase price of the products (including VAT if applicable) and the applicable transportation/shipping costs.
10.6. We urge you not to attempt to make payment by any other means not specified at www.jorlop.pt. If you try to do so, “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” cannot be held responsible for the loss of the monetary value paid, or any other damages that may result.
11. SECURITY OF THE JORLOP ONLINE STORE AND ALL TRANSACTIONS
11.1. The JORLOP online store uses the latest and most robust security technologies available for data encryption. All the information you provide will be encrypted, from the initial moment of your transaction until the order is processed, and will not be stored on any public server.
11.2. Although we use highly advanced encryption software, any payment transmitted over the Internet, or via e-mail, runs certain risks, particularly when the “User” does not take the necessary precautions and does not assume the necessary responsibility.
11.3. “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” cannot be held responsible for any damage suffered as a result of the use of electronic means of communication, namely damage resulting from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications or virus transmissions.
12. RESERVATION OF OWNERSHIP OF MARKETED PRODUCTS
12.1. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” retains ownership of all products on the website until it has received full payment for the order.
13. PRICES
13.1. The prices of the products displayed on the website www.jorlop.pt contain/include Value Added Tax (VAT).
13.2. The total price specified at the end of the purchase process includes taxes and shipping/delivery costs. Prices are quoted on the order confirmation, which you can print out or download for future reference. The “Customer” must only pay the exact amount specified in the order confirmation.
13.3. Shipping fees are calculated per order, and the exact price of the shipping fee will depend on the country and location where your order will be delivered and, possibly, on the total value of the purchase.
13.4. All prices are in Euros and any change in the country or place of delivery may affect prices due to transportation costs.
14. QUALITY AND GUARANTEE
14.1. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA will only sell quality products at www.jorlop.pt and will never sell second-hand products, defective products or products of inferior quality to the standards on the market.
14.2. The products available on www.jorlop.pt may not correspond exactly to the final product in terms of the image displayed and colors, especially due to the internet browser and monitor used.
15. SHIPMENT OF PRODUCTS AND DELIVERIES
15.1. Products ordered from the JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA online store will be dispatched and delivered on working days, Monday to Friday.
15.2. We can only guarantee the proper delivery of an order if the shipping address of the products is correctly indicated by the “User”.
15.3. A delivery is deemed to have been made or a product is deemed to have been delivered when the delivery receipt is signed at the agreed address.
16. SHIPPING COSTS
16.1. The shipping costs associated with your order will be billed per order, i.e. if you order more than one item, you will only pay the shipping costs once.
16.2. Shipping costs to mainland Portugal will be 7.5€ per order up to 20kg. Above 20kg, a cost of 0.35€ is added for each additional kg.
16.3. In the archipelagos of Madeira and the Azores and other countries, deliveries will be quoted according to the total volume of products purchased.
16.4. The “Buyer” must inspect the packaging and products received for any damage. If they find that the products are damaged, they must contact JORLOP within 24 hours by e-mail (jorlop@jorlop.pt) or via the helpline.
17. DELIVERY TIMES FOR ORDERS
17.1. Once your order has been registered, payment has been confirmed and all the items in your order are available, “JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA” undertakes to dispatch them in accordance with the following delivery times:
a) In mainland Portugal, an average of 2 to 3 working days.
b) In the archipelagos of Madeira and the Azores, within an average of 5 working days.
c) In the European Union (except Portugal), an average of 3 to 5 working days.
d) In all countries outside the European Union, we will deliver the order within an indicative period of 8 working days.
17.2. Any delay in the dispatch of items in relation to the estimated dates given shall not entitle the customer to any compensation.
18. PRODUCT EXCHANGES AND RETURNS
18.1. If for any reason the order does not meet your expectations, you can return it to us. In this case, you will have 15 days from the date you received the order to return the products to us.
18.2. Any return/exchange of items must comply with the following conditions:
a) Return of items in good condition (in saleable condition), with original unopened packaging, without having been tried on and accompanied by the relevant invoice. If the packaging is damaged and the items show obvious marks of use, we will not be able to accept an exchange, refund or credit.
b) The receipt(s)/purchase slip(s) must accompany the product(s).
c) You should contact our Customer Service team at jorlop@jorlop.pt to inform them of your intention to exchange or return the product, indicating the order number or invoice number, the products to be returned and the reason. After this contact, you will be given instructions on how to proceed with the exchange or return. Under no circumstances send the items without prior contact as they will not be considered for exchange/return.
Once you have contacted our Customer Service and been given the details of the return/exchange, you must send us the item properly packaged and in the conditions mentioned above, to our address:
If you wish to exchange or return any of your items, you can also go directly to Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda., accompanied by the purchase invoice.
18.3. If the “Customer” chooses to exchange the product, the shipping costs to our address are borne by the customer, except for customers injured by transportation or a technical problem with the product. In these cases, the shipping costs will be borne by Jorlop – Plásticos e Papel, Sociedade Unipessoal, Lda. Exchanges will only be made once the condition of the product has been checked and the above conditions have been met.
18.4. If you choose to return or credit the amount, refunds or credits (for online store purchases) will be made for the total value of the order (products plus shipping costs), unless the reason for the return is not the responsibility of our service – in these cases, shipping costs will be deducted from the refund amount. Returns will only be made once the condition of the product has been checked and the above conditions have been met.
19. ORDER CANCELLATION
19.1. Before shipment, the “Buyer” can cancel the product order. If the “User” places an order and wishes to cancel it, he/she must first check the status of the order via the “Account” menu, located in the top right-hand corner of the main page of the www.jorlop.pt website, then click on “Order history”, and if the status of the respective order mentions “Pending” or “In process”, then there is a possibility that it can still be canceled. To do this, the “User” should contact our Customer Service and ask for the order to be canceled.
19.2. If the cancellation request is successful, the customer will be notified by e-mail of this decision and the cancellation will be processed at no cost to the customer.
19.3. If the request for cancellation is not possible because the order has already been dispatched, the products will be sent to the “Buyer” who, if he/she maintains his/her intention to cancel the order, must return it, under the conditions referred to in article 18 of this document.
19.5. If the order is to be picked up at JORLOP’s premises, it can be canceled at any time. If the “Customer” has already paid for the products, they can obtain a refund by contacting Jorlop – Plásticos e Papel, Sociedade Unipessoal Lda, or they can keep the balance in the online store, depending on their preference.
20. VALIDITY OF PROMOTIONS OR COMMERCIAL CAMPAIGNS
20.1. Promotional offers or commercial campaigns published on the www.jorlop.pt website are valid for the periods shown on the site and in accordance with the conditions established.
20.2. If you return or exchange items purchased as part of commercial campaigns or promotions, you will only be credited or given the amount you actually spent on the product you wish to return or exchange.
21. RESPONSIBILITY
21.1. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA shall only be liable for damages suffered by the “Buyer” in the event that such damages result from breaches attributable to the contractual obligations of JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA towards the “Consumer”, or in the event that liability results from applicable legal law.
21.2. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA cannot be held responsible for any damage suffered by the “Buyer” as a result of improper use of our products.
21.3. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA is not responsible for any damage resulting from incorrect information on the website or on the product itself.
21.4. All products marketed by JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA are in accordance with the Portuguese and Community legislation.
21.5. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA disclaims any liability in case of violation of the legislation of the country where the order is delivered. It is the Customer’s responsibility to verify with local authorities the conditions for importing or using the products he wishes to order.
22. INTELLECTUAL AND INDUSTRIAL PROPERTY
22.1. All texts, comments, works, illustrations, works and images reproduced or represented on the website www.jorlop.pt are strictly reserved under the terms of copyright as well as intellectual property rights, for the entire world.
22.2. Accordingly, and under the terms of the Intellectual Property Code, the use of information for private purposes is only authorized, subject to contrary provisions, including more restrictive provisions contained in said code.
22.3. Any total or partial reproduction or representation of the website www.jorlop.pt or the elements included therein is strictly prohibited.
22.4. The corporate names, brands and distinctive signs reproduced on the website www.jorlop.pt are protected under the legal provisions applicable to industrial property. The reproduction or representation of all or part of any distinctive signs is strictly prohibited and must be subject to prior written authorization from the owner of the JORLOP trademark.
22.5. If the “User” wishes to use information or materials from the website, he/she must obtain prior written authorization granted by JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA.
23. APPLICABLE LAW
23.1. These Terms and Conditions and all emerging disputes that are related to these general conditions, including their validity, the use of the website www.jorlop.pt or any purchase on it must be governed by Portuguese Law.
23.2. In the event of a dispute regarding the interpretation or execution of these Terms and Conditions, JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA and the “Buyer” undertake to endeavor to obtain an amicable solution, which is fair and adequate, within a maximum period of 60 (sixty) days from the receipt of the communication addressed for this purpose by any of the parties involved.
23.3. In the absence of an amicable solution, in accordance with the provisions of the previous paragraph, and in case of non-compliance with these Terms and Conditions, both PARTIES establish the Civil Court of Guimarães as the competent court, with express waiver of any other.
24. CHANGES TO TERMS AND CONDITIONS
24.1. JORLOP – PLÁSTICOS E PAPEL, SOCIEDADE UNIPESSOAL LDA has the right to change these Terms and Conditions at any time. The “Buyer” is subject to the principles and terms in force on the date of their order, unless the law or competent authority imposes any change to them.
